01. SCOPE OF THIS PRIVACY POLICY
1.1 Welcome to the User Privacy Policy (“Privacy Policy”) of Kamoto.ai ( hereinafter “Kamoto.AI”, "we", us", or “our”). This Privacy Policy is applicable to the Platform, application and any other modes ("Tools") through which Kamoto.AI provides its Services. This Privacy Policy is made available to you by Kamoto.AI.
1.2 As used herein, the term “you” (including any variant) or “User” refers to each individual user who interacts with the Platform and/or Tools and enters into this Privacy Policy on such individual’s own behalf or any entity on behalf of which an individual enters into this Privacy Policy. This Privacy Policy shall be referred to and read as an integral part of the Terms of Use of Kamoto.AI (“Terms”).
02. GENERAL INFORMATION
2.1 Please read this Privacy Policy carefully to understand our policies and practices regarding your personally identifiable information as this Privacy Policy explains how we collect, use, and disclose your Personal Data (defined hereinafter) if you decide to use our Services. It reflects our approach to collect, record, organize, structure, use, hold, store, adapt, alter, retrieve, process, align, combine, structure, index, organize, use, transfer, restrict, erase, destroy, disclose, transmit, share, disseminate or otherwise make available your Personal Data in accordance with applicable laws.
2.2 Undefined capitalized terms used herein shall have the meaning set forth in the Terms.
2.3 Please note that Kamoto.AI currently does not respond to ‘Do Not Track’ requests. Normally browsers these days come with a setting known as ‘Do Not Track’ which signals to the website that a User chooses or wishes not to be tracked
03. YOUR ACCEPTANCE OF THIS PRIVACY POLICY
3.1 By accessing the Platform, or using our Services, or by submitting your Personal Data to Kamoto.AI, you acknowledge and consent to the terms of this Privacy Policy and you will be treated as having given your permission for processing, storage, and access to the Personal Data including collection of Personal Data at different points in our Tools that may or may not state that Personal Data is being collected, in the manner provided in this Privacy Policy. If you do not agree with our Privacy Policy, we may not be able to provide you with our Services.
3.2You may withdraw your consent by writing to us, on the contact details provided in this Privacy Policy, at any point in time. If you do not agree with the terms of this Privacy Policy, do not use the Services. The Personal Data that we collect is used for providing and improving the Services. We will not use or share your information with anyone except as described in this Privacy Policy.
3.3By accessing or using this Application, you confirm that you are not a minor i.e., are of at least 13 (thirteen) years of age (or such higher age as prescribed under the applicable laws of the jurisdiction from which you access and use the Services, for you to be bound by a contract without guardian consent) at the time of access ("Competent Age").
04. HOW IS YOUR PERSONAL DATA COLLECTED?
4.1 Information Kamoto.AI gathers itself.
- "Personal Data" refers to any information/data that relates to an individual who is identified by or in relation to such data. We obtain Personal Data relating to you from various sources described under this Privacy Policy. When you sign up/in our Services or at any other prompted time, basic personally identifiable information that we may collect from you, including but not limited to, your first, middle, last and maiden name, e-mail and mailing addresses, social media addresses, contact numbers, login details (username and password for the Platform and Tools), phone number, chat history, interaction history, AI call history unique device ID number, or any other form of data that is ancillary to any of the data mentioned herein.
- We collect information about your interactions with our website and Services, including log data, IP addresses, device information, and browsing activity.
4.2 Information provided by the User.
Kamoto.AI may gather all and/or any information that you knowingly opt to disclose, which may include but is not limited to
- The audio recordings, videos, images, messages, text, attachments, files, conversations, associated metadata, and other content submitted through or uploaded to the Kamoto.AI;
- Information you provide as part of your account registration with Kamoto.AI, which may include your name, organization name, address, telephone number, email address, username and password; optional information that you may choose to provide, such as a photograph or basic demographic data;
- Information you provide in other interactions with us, such as requests or questions you submit to us via forms, email, or through a third-party communication website; and requests for customer support and technical assistance (over which Kamoto.AI retains control in order to provide our Services to you);
- Two-factor authentication services or other allied services may require our collection of the User’s phone number. We may associate that phone number with your mobile device identification information.
- When connecting to our Tools through a service provider that uniquely identifies your mobile device, Kamoto.AI may receive this identification information and use it to extend or offer services.
- Basic identification information and other ancillary information that is provided by the User at the account creation or any other registration process which is automatically prompted or opted for during the use of the Services.
- The User may make a multitude of choices or preferences during the use of the Services, such as safe search settings, notification settings, favourite widgets, or location settings. These preferences may then be attributed to the User or the devices that they are using and are also allowed to be amended or changed by the User.
- If the User is using the Services on a mobile device, the unique identification number of the device and other ancillary information about the device.
- If the User makes any correspondence with us through email, all the contents of the email may be gathered for giving you a reply and quality assurance purposes.
- Information about any purchase or transactions made on the Tools. This includes payment information, such as your credit or debit card number and other card information; other account and authentication information; and billing, shipping, and contact details.
- We also collect other types of Personal Data that you provide to us voluntarily, such as your operating system and version, product registration number, Polygon address, and other requested information if you contact us via e-mail regarding support for the Tools.
- AI Personalities Data: To create and train AI personalities, you may provide structured data or content that reflects your preferences and desired behavior.
By sharing your Personal Data with us and using our Services you agree and undertake to always:
- be in compliance with applicable laws;
- ensure not to impersonate another person while providing your Personal Data for a specified purpose under this Privacy Policy; and
- ensure not to suppress any material information while providing any Personal Data for any document, unique identifier, proof of identity or proof of address.
4.3 Information Kamoto.AI automatically gathers
Kamoto.AI may be using tools or technologies that gather or collect information relating to your technological equipment, browsing actions, and patterns as you navigate through and interact with our Platform and Tools automatically. This includes but is not limited to information collected by:
- Servers. The servers used by Kamoto.AI (which may be hosted by a third-party service provider) are designed to make the Tools offered by Kamoto.AI more interactive and useful for its Users. Servers gather data from you which comprises the name of the domain, browser kind, operating system Internet Protocol address type of wallet being used, and/or the date and time of your visit.
- Web Beacons. These are small graphic data that are embedded in webpages, applications, and emails (often referred to as, “pixel tags”, “clear GIFs”, “web bugs”, or “single-pixel gifs”). Web Beacons are sent for the purpose of gauging the User’s interest in the outgoing communication. This in turn helps us to only send more relevant emails, or upload more relevant content and increase the effectiveness of Kamoto.AI’s marketing.
- Cookies. We also use cookies to provide a more interactive and tailored experience to its Users. Cookies contain information on the navigation carried out on the pages of the Platform and Tools. We use cookies to help identify and track visitors, their usage of the Platform and Tools, and their Platform and Tools access preferences to provide a more dedicated and tailored experience to all its Users. You have the option to refuse to accept browser Cookies by activating the appropriate setting on your browser for any reason. However, if you disable or refuse cookies, please note that some parts of our Platform and Tools may then be inaccessible or not function properly. Users are advised to look up the acceptance and rejection of cookies on the help menu provided in their respective web browsers and on the web, too.
- Log Files. Log files information is automatically reported by the browser each time you visit a web page as they record and track computing events. When you access our Platform and Tools, our servers automatically record certain log file information, such as IP address, browser type, internet service provider (“ISP”), referring/exit page(s), operating system, date/time stamp, clickstream data and how you interact with links on our Platform and Tools, domain name, pages views, and such other information. This information also helps us to improve our Platform and Tools by providing the User with a more dedicated and tailored experience each time he uses the Tools.
- Entity Tags. Entity Tags are HTTP code mechanisms that help to manage web caching behavior. It is used to determine whether a component in your browser matches these caches when the Platform is opened, this helps in accelerating the Platform’s performance since the web server does not need to send a full response if the content has not changed
05. SPECIFIC PURPOSE
5.1 The Personal Data is collected and processed for the legitimate business interest of complying with the applicable laws. We are subject to certain legal requirements which may require us to process your Personal Data. We use your Personal Data to:
- identify you as a User of the Platform and/or Tools in order to let you take full advantage and access to certain features of the Platform and Tools and provide the Services;
- administer or carry out the purpose for which you have provided or we have collected the Personal Data;
- enhance and improve the quality of experience of the User’s interaction with Tools by obtaining feedback or contacting the User in relation to the Tools;
- communicate with you, including to information you about features or aspects of the Services, Platform and/or the Tools we believe might be of interest to you;
- engage in other communications with you, such as to respond to your inquiries, comments, feedback, or questions;
- analyze, maintain, improve, modify, customize, and measure the Services, including to train our artificial intelligence/machine learning models;
- Develop new programs and services;
- Detect and prevent fraud, criminal activity, or misuses of our Service, and to ensure the security of our IT systems, architecture, and networks;
- understand and analyze trends, including how you use our Services, to identify future opportunities for the development, promotion and improvement of our Services, Platform and Tools to identify new customers, to expand our business activities and to determine the effectiveness of our promotional campaigns and free trials in reliance on our legitimate interest in developing and improving our Services, or where required, with your consent;
- anticipate and resolve any dissatisfaction or problem in relation to the Tools;
- provide you with support, to respond to your inquiries and to address your concern to improve our responses in relation to the Platform and Tools, troubleshoot and diagnose technical problems and provide our customer care and support services, including to help us provide, improve, and secure the quality of our products, services, and training, and to investigate security incidents
- provide you notifications about changes to our Services or any change in administrative, security and maintenance policies;
- diagnose or fix technological errors in relation to the Services;
- maintain the safety and security of our Services, including detecting, preventing, or otherwise addressing fraud, verifying accounts and activity, investigating suspicious, unauthorized, or illegal activity, and enforcing our terms and policies, in reliance on our legitimate interest in promoting the safety, integrity and security of our Services, systems and applications and in protecting our rights and the rights of others.
- combine with information that we get from other sources or from you to help understand your needs and provide you better Services;
- conduct studies and analysis of trends, usage and activities for effective marketing or other advertising purposes including using your Personal Data to send promotional communications, including product recommendations, and other non-transactional communications (e.g., marketing newsletters or push notifications) about Kamoto.AI according to your marketing preferences;
- develop, test, and improve new products or services by your participation in surveys and research;
- process your Personal Data when cooperating with public and government authorities, courts or regulators in accordance with our legal obligations under applicable laws, to the extent this requires the processing or disclosure of Personal Data;
- send you, through e-mails, newsletters, promotional offers, contests, and events that might be of your interest; and
- use your Personal Data for any purpose where you have given your consent (where legally required).
06. DISCLOSURE OF PERSONAL DATA
6.1 We may use or disclose generic aggregated and anonymized data that is not linked to any direct personal identification for purposes related to the Platform and Tools. We do not sell, trade, or rent Users’ Personal Data to others. The Personal Data collected from the Users will not be disclosed by Kamoto.AI to third parties, except the parties with whom we share your Personal Data in accordance with this Privacy Policy.
6.2 To seek help to provide, analyse, and improve our Platform or Tools we may share the Personal Data with the businesses that are legally part of the same group of companies that we are a part of, our affiliates, parent company, subsidiaries, joint venture or that become part of that group, these companies may be located in other countries outside your residential country. You understand and accept that these countries may have differing (and potentially less stringent) laws relating to the degree of confidentiality afforded to the information it holds and that such information may become subject to the laws and disclosure requirements of such countries. If we transfer your Personal Data, the recipient entities shall be bound by the terms of this Privacy Policy or the data privacy and data protection laws of the recipient entity, whichever are more stringent.
6.3 We may share Personal Data with contractors, third party service providers, or business partners that help us operate our business, the Platform and Tools, or administer activities on our behalf. They may use the Personal Data to help us improve our Tools and your interaction with the Platform and Tools by conducting quality assurance testing, providing services through our Tools, or providing analytical services.
6.4 If we plan to merge with, or be acquired by a business entity, or take part in sale transfer, or divestiture, or re-organization, or enter into amalgamation, or restructure the business, in such event we may have to sell or otherwise transfer part or the whole of Kamoto.AI ’s assets to another organization, and your Personal Data and any other collected information may be among the items sold or transferred. In the event of the appointment of receivership, insolvency, or bankruptcy of Kamoto.AI, the Personal Data may form part of the assets of Kamoto.AI. By accessing, availing and using the Services, you expressly consent to any such transfer of Personal Data which may be effectuated as a result of such corporate restructuring process.
6.5 Kamoto.AI may disclose your Personal Data if Kamoto.AI believes in good faith that the disclosure is necessary (i) to respond to claims that an advertisement, posting or other content violates the rights of a third party; or (ii) to provide assistance in the investigation or for preventing any violation or potential violation of the law, this Privacy Policy, or the Terms. When the Personal Data is subject to a legal request or obligation, governmental investigation, or investigations concerning possible violations of our Terms or any policies, then we may access, process or retain the Personal Data for an extended duration.
6.6 If the Users provide their Personal Data in the publicly accessible areas of our Tools, in which case the User will be deemed to have consented to the disclosure of their Personal Data as this may result in the Personal Data of the User running into the access of any visitor of our Tools and would not be immune from being collected, stored or misused.
6.7 We may disclose Personal Data to enforce or apply the Terms, including for billing and collection purposes.
6.8 We may disclose the Personal Data to fulfil the purposes for which the User provides it, or for any other purpose disclosed by us when you provide the information or with your prior consent.
6.9 We may disclose your Personal Data to non-affiliated third parties based on your explicit consent to do so. For instance, you may direct us to disclose Personal Data about you when you refer us or our Services to your friends or other acquaintances.
07. YOUR RIGHTS OVER PERSONAL DATA
7.1 You can send us an email at [email protected] to request access for modification, correction, completion, updation, erasure, or deletion of any Personal Data that you have provided to us and that we have about you. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. You may also update your Personal Data in your profile on Kamoto.AI via the settings.
7.2 Your local law may provide you certain rights with respect to your Personal Data. Depending on your jurisdiction and subject to applicable law, you may have the following rights with respect to the Personal Data that we process:
- rectify incorrect or incomplete Personal Data, update or erase it in certain circumstances or make any modification to your Personal Data, provided that you furnish only such information that is verifiably authentic, while exercising the right to correction or erasure under this Privacy Policy;
- restrict or object to the processing of your Personal Data, unfortunately, after such restriction, you will not be able to access our Tools;
- obtain confirmation from us as to whether we are processing your Personal Data and the right to access and receive a copy of such Personal Data including a summary of the Personal Data which is being processed and any other information related to your Personal Data
- its processing, as may be prescribed.
- once you have consented to the collection of your Personal Data, you may withdraw your consent at any time. Please note that your withdrawal of consent would not affect the lawfulness of processing such Personal Data based on consent before it was withdrawn. Withdrawal of your consent may affect the Services;
- request information about whether we have any Personal Data about you, to access such Personal Data;
- opt-out from providing your sensitive personal data, if we collect any to us, however, we may not be able to provide you with certain Services dependent upon such data if you do not provide us with such information;
- right to get your Personal Data erased from our systems. Unless there is a reason that the law allows us to use your Personal Data for longer, we will make reasonable efforts to comply with your request;
- restrict the way that we process and disclose certain information about you; and
- right to object at any time to the processing of Personal Data, including a right to object to the processing of your Personal Data for processing performed on the basis of legitimate interest, unless we are able to demonstrate overriding compelling legitimate grounds.
7.3 Please be informed that we will grant your request within 30 (thirty) days after receiving it. You understand that in certain instances it may take up to 90 (ninety) days, such as, for full erasure of your Personal Data stored in our backup systems, this is due to the size and complexity of the systems we use to store Personal Data.
7.4If you choose to withdraw your consent to the processing of Personal Data, we shall, within a reasonable time, cease processing such Personal Data of yours, unless such processing without your consent is required or authorised under the applicable law.
08. PROMOTION
8.1We may, from time to time, sponsor contests or other events (“Promotions”) which require the collection, processing, and storage of individual contact information plus demographic information (such as age, gender, area of interest, etc.). Those Users who register for such Promotions may have to answer certain survey questions. Any personally identifiable information collected through Promotions will be treated as Personal Data.
8.2 If we organized a Promotion by co-sponsoring with other companies, then any information collected is likely to be shared with such other participating sponsors, who may use this information. A registered User’s personal contact and demographic information will only be shared with the named sponsors. You agree and explicitly consent to sharing any such information and acknowledge that this forms part of the legitimate purpose for which we may collect any Personal Data under this Privacy Policy.
09. UNSUBSCRIBE TO COMMERCIAL OFFERS
9.1 If you agree to receive commercial offers, you can at any time request to stop receiving this type of information:
- by modifying your Personal Data on the Platform; or
- by clicking on the unsubscribe link provided for this purpose in each email you receive.
10. PERSONAL DATA WITH SOCIAL MEDIA
10.1 The Platform uses or may use in future (if not already using) plug-in (or plug-ins) from social networks, including but not limited to Facebook, Twitter, Instagram, etc. (hereinafter and together the “Social Networks”).
10.2 If you interact on the Platform using these plug-ins, for example by clicking on the "Like" or "Share" button, the information related to your browsing on the Platform and your membership in these Social Networks will be transmitted, recorded, and processed on a server of the company operating the Social Network concerned and linked to your user account, according to the conditions of use which are specific to it. This Privacy Policy does not cover the privacy and security practices of the Social Networks on which we have our social media pages. If you do not want your Personal Data to be transmitted from the Platform to Social Networks, we advise you in this case:
- not to interact with these Social Networks by clicking on the plug-ins available to you on the Platform ;
- to deactivate your account on the Social Network in question before browsing our Platform; or
- to navigate in private mode via your browser.
11. USERS FROM OUTSIDE USA
11.1 Our Services are global and your information may be stored and processed in USA and other countries outside USA that may have data protection laws that differ from the laws in your country, and your Personal Data may be accessible to law enforcement and national security authorities under certain circumstances. 12. RETENTION OF PERSONAL DATA
12.1 The Personal Data collected from the Users may be used for as long as it is necessary to fulfil the purposes outlined herein in the Privacy Policy or as otherwise required by applicable law, especially for the period in which the User is using the Services. The duration for which we store your Personal Data varies depending on the purpose of the processing. We will retain the Personal Data for as long as is required for the purpose consented to or until you withdraw your consent or is otherwise legally required. If you have revoked your consent, we may nevertheless retain certain Personal Data for the period required in order for us to meet our legal obligations and defend ourselves in legal disputes.
12.2 If we have not received your consent for processing, the Personal Data will only be retained to the extent we are permitted to do so by applicable law.
12.3 Unless we are required or permitted by law to store your Personal Data for a longer period of time, when the Personal Data is no longer necessary to carry out the legitimate purposes for which we process it, we will delete your Personal Data or keep it in a form that does not permit identifying you. If there is any Personal Data that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent any further use of that Personal Data.
12.4 In case you wish to close your account with Kamoto.AI, the process of closing your account is set out on the Platform. You may opt to close your account by contacting us as described above, and we will delete your Personal Data upon request.
13. SECURITY PRECAUTIONS
13.1 Our Platform has stringent security measures in place to protect and secure the Personal Data under our control. Once your Personal Data is in our possession we adhere to strict security guidelines, protecting it against unauthorized access. We have a comprehensive documented information security program and policy in place and we review it periodically to keep pace with commercial, technology, and regulatory changes. Although we have taken effective measures to protect the Personal Data, we cannot guarantee the security of the Personal Data transmitted to or via our Platform or Tools or an absolute guarantee that such information may not be accessed, disclosed, altered, or destroyed as you are aware that the transmission of information via the internet is not completely secure. Please understand that there is no ideal technology or measure to maintain 100% security. Any transmission of your Personal Data is at your own risk. The safety and security of your Personal Data also depend on you. You are solely responsible to keep your log-in credentials confidential and not reveal them to others where we provide you (or where you have chosen) a User ID and password to access the Platform and/or Tools. We will however, at all times follow and maintain the prescribed minimum standard of securityg as required under applicable law.
13.2 Notwithstanding anything contained in this Privacy Policy or elsewhere, we shall not be held responsible for any loss, damage, or misuse of your Personal Data, if such loss, damage, or misuse takes place as a result of a Force Majeure Event (as defined below).
13.3 A "Force Majeure Event" shall refer to any event that is beyond our reasonable control and shall include, without limitation, fire, flood, explosion, acts of God, civil commotion, strikes, insurrection, war, epidemic, pandemic, acts of government, computer hacking, software failure and storage device, computer crashes etc.
13.4 We will promptly and in compliance with applicable law report appropriate authorities about breach of any Personal Data processed by us, in accordance with applicable law. We will take necessary directions and remedial measures directed by such authority to prevent further loss of information or mitigate harm, as may be specified. We may also contact you to report such breaches to you based on directions issued by authorities under applicable law.
14. THIRD PARTY LINKS
13.1 This Privacy Policy applies only to the Services, and not to any other website, services, or products that you may be able to access via the Platform and Tools. Please note that the Platform and Tools may contain content, advertisement, text, and graphic that link to our partners, suppliers, advertisers, sponsors, and other third party’s social media websites and services that may also collect information from you. In each of the said cases, we have no control over the privacy policy of any third-party and are not responsible for the practices employed by websites linked to or from our Platform and Tools. We advise you to please examine their privacy policy prior to submitting any personal information as browsing and interacting on any other website, including websites that have a link to our Platform and Tools, is subject to that website’s own terms and policies.
15. CHILDREN’S PRIVACY
15.1 Our Platform and Tools are not intended for or directed at children under the Competent Age. A child below the Competent Age shall not provide any 'personal information' as defined under applicable law, to or on the Platform and Tools.
15.2 We do not knowingly solicit or collect Personal Data from children below the Competent Age. If you are under the Competent Age, do not use or provide any information on this Platform and Tools or on or through any of its features/register on the Platform and Tools, make any purchases through the Platform and Tools, use any of the interactive or public comment features of the Platform and Tools or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use.
15.3 If we find out we have unintentionally collected or received personal information from a child under the Competent Age, without verification of parental consent, we will promptly take necessary steps to delete such information. If you learn that anyone younger than the Competent Age has provided us with personal information, please contact us at [email protected] to request the deletion of any such personal information so received.
16. DIGITAL WALLETS
16.1 Digital Wallets used by the User, provide us with information, including but not limited to, Credit or Debit Card information and certain other information you choose to share with the wallets. These third-party companies may supply us with Personal Data. We may add this to the information we have already collected from you via our Tools in order to improve it. We do not collect Personal Data automatically, but we may tie the information.
17. KYC VENDORS
17.1 Personal Data may be collected by Know Your Customer ("KYC") vendors. This collection of Personal Data is for the purposes of complying with the rules and regulations on Anti-money Laundering and combatting the financing of terrorism. KYC vendors do not collect this Personal Data without the consent of the User. Nonetheless, the User must be aware that Kamoto.AI has no control or authority over the collection, storing or security of Personal Data done by KYC vendors and any Personal Data provided by the User to the KYC vendor is subject to the Privacy Policy of the respective KYC vendor.
18. CHANGES TO PRIVACY POLICY
18.1 We reserve the right to amend, modify, add, delete or supplement this Privacy Policy and/or our data handling or consent practices or procedures at any time without prior notice in order to meet any new legal requirements or for any other reason, that we deem fit and appropriate. Please review this Privacy Policy periodically as you acknowledge and agree that you are entirely and solely responsible for updating yourself with the new and amended Privacy Policy. We will notify the User of the changes made in the Privacy Policy by email and we will update the “Last Updated Date” above to indicate when those changes were made. Your continued use of the Services by you, following the posting of changes to this Privacy Policy will be deemed as an implicit (or express, if consent has been obtained from you, as the case may be) acceptance of this Privacy Policy in its amended form.
18.2 If you are accessing or using the Services through the Platform from an overseas location, you do so at your own risk, and shall be solely liable for compliance with any applicable local laws.
19. GRIEVANCE REDRESSAL AND CONTACT US
19.1 If you have any questions about this Privacy Policy, the practices of Kamoto.AI or your dealings with the Platform, you can contact us using the information given hereunder and reach our grievance redressal officer.
